The "fitplay" app (hereinafter "fitplay") is distributed by AppLike GmbH, 22769 Hamburg (Hereinafter "we" or "us"). When using fitplay, we collect, process and use data. Because we care about your privacy when using fitplay, we would like to provide you with the following information about what personal data we collect when you use fitplay and how we deal with that data. You can access this privacy statement at any time under the "Imprint" section of the app.

AppLike GmbH, 22769 Hamburg, is responsible for the purposes of the Data Protection Act.

Collection and use of your data
We use your data without your separate consent to the fulfillment and execution of the agreement on the use of fitplay. In this context, we will use your data primarily to calculate and pay for the bonuses you earn during your use of fitplay and to inform you about apps participating in fitplay. Any further use will only be carried out on the basis of other statutory obligations or permissions or if you have given us a consent.
Login and use of fitplay / Facebook or Google+ Login
To use fitplay, you must log in. To log in, you must enter the following data:
- Username (your e-mail address);
- Password
- Age
- Gender
Your data is SSL encrypted and thus securely transmitted. If you choose to log in automatically, the password is stored with an SHA encryption to protect your data.
Alternatively, you can log in with your Facebook or Google+ login. Additional registration is not required. To login, you will be redirected to the Facebook or Google page, where you can log in with your usage data. We automatically receive the following information from Facebook or Google:
- Your email address;
- gender;
- Your date of birth.
This information is mandatory to identify you.
The use of the Facebook or Google+ Logins may lead to your personal data being collected by Facebook or Google, possibly being transferred outside the EU / EEA and possibly also stored and used there. These data surveys and uses are the responsibility of Facebook and / or Google. We are not aware of the exact handling of the data by Facebook or Google. For more information about these services and any privacy settings provided by the provider, please refer to the Privacy Policy and Terms of Service of Facebook and / or Google.
Terms of use
Through fitplay, we collect and store certain data automatically. This includes both the IP address assigned to your terminal, as well as the IMEI and Android, Device and Google Advertiser IDs, which we need for the transmission of the content you have requested (e.g. texts, pictures, games and product information, as well as provided files, etc.), as well as information on the use of fitplay, so e.g. the operating system used, the type of browser used, and the date and time of the usage. We use this data on the one hand, in order to be able to identify you with no doubt, and on the other hand, if necessary, in an anonymous form for the optimized presentation and the appropriate design of fitplay.
Registration / creation of a user account
In order to benefit from all the features of fitplay, and in particular to benefit from the bonus payments, you must register to use fitplay by setting up a user account. The registration therefore serves both the provision of the services of fitplay as well as the payoff of the bonuses you have earned. As part of the registration process, we collect and store certain personal data from you. This is done by creating a customer account.
This includes the following:
- First and last name as well as title, possibly title;
- address (street, house number, zip code, city);
- E-mail address;
- gender (optional);
- Payment data (address of a PayPal account or connection data of other online accounts or a bank account (IBAN / BIC or Kontonummer and BLZ))
Calculation of bonus payments / suggestion of new apps
In order to calculate the bonuses you have earned, as well as to suggest other apps which are part of fitplay, we automatically collect and process certain data. This includes information on the apps installed on your device. When you install fitplay, a list of currently installed apps is sent to us; if you install additional apps on your device after installing fitplay, fitplay recognizes them and sends the name of the newly installed app to us.
On the other hand, we collect data about the use of the apps running on your terminal in the foreground. This includes information on the duration of the use as well as (to prevent abuses) about the display and movement activity during the use. We also collect information about your purchases of services and virtual items as part of the apps you use (in-app purchases), as well as in-app events relevant to the calculation of bonuses, such as level increases.
Processing of bonus payments
To pay out the bonus payments you have made, we use your payment data as part of the registration process. This can be a PayPal, another online account or a conventional bank account.
Contact area
In the contact area of the app you can contact us by e-mail. Your e-mail address will be forwarded to us. You can decide which data you provide to us as part of the contact process.
Consent to use / revoke consent
You may have given us the following consent in the commercial use of your data:
„I hereby confirm that fitplay uses the following information for personalized advertising for apps available in fitplay in our app and via system messages.
- Downloaded apps (including usage & in-app purchases)
- Registration data (email, birthday, gender)
The data is linked to the user's terminal via Android and device ID. I can revoke this consent at any time. "
You may also have given us the following consent in the commercial use of your data:
“In addition, I agree that G + J will provide me with information about offers in the apps and gaming area, regarding provider who´s apps are available within the fitplay app, through email, SMS, instant message, and, if enabled, system notification based on my usage behavior and the hence determined app preferences."
In such a case, we use the data specified in the consent in accordance with your consent. You can revoke your consent at any time with effect for the future by contacting us either by mail (AppLike GmbH, Stresemannstraße 29, 22769 Hamburg) or by e-mail datenschutz@applike.info. Use of fitplay is then possibly not possible.
Authorizations to access functions and data on the device:
To use all features of fitplay, you must grant fitplay permission to access functions and data on your device. In particular, the following accesses are required for the purposes mentioned:
- INTERNET: Allows access to the Internet for data retrieval;
- ACCESS_NETWORK_STATE: Allows to check if an Internet connection exists;
- GET_ACCOUNTS & USE_CREDENTIALS: Access to the accounts associated with the mobile phone, such as Google Account
- WAKE_LOCK: Used to wake up the device in the case of an incoming fitplay Notification (GCM);
- VIBRATE: Used to allow the mobile phone to vibrate with an incoming fitplay Notifcation;
- C2D_MESSAGE: Required for fitplay Notifcation via GCM;
- GET_TASKS: allows you to view the process of the most active app;
- READ_PHONE_STATE: allows the app to check the display activity.
You also granted us the following authorization:
"fitplay would like to do the following:
Use SID, and LSID cookies to access all their Google Accounts."
We may use this access only to access your Google Wallet. We use the data provided to track your in-app purchases, as well as to calculate the bonus payments you received and propose new apps to you (see section 2.4).
In addition, we will only use the granted authorizations for the aforementioned purposes, even if authorization granted (for technical reasons, for example) opens up further possibilities of use. In the normal case, you can undo a given authorization in the settings of your device at any time (this is however dependent on your device and the operating system, which we have no influence on).
Transfer of data
In addition to the other cases mentioned in this data protection declaration, the transfer of your personal data without your explicit prior consent occurs only in the following cases:
- If it is necessary to clarify an unlawful or abusive use of fitplay or for the prosecution, personal data will be passed on to the law enforcement authorities and, if necessary, to a harmed third party. However, this only takes place if there are concrete indications of unlawful or abusive behavior. A transfer may also take place if this serves the enforcement of conditions of use or other agreements. We are also obliged by law to provide information to certain public authorities on request. These are law enforcement agencies, authorities, which pursue administrative penalties and the financial authorities.
- Occasionally, to provide our service, we depend on external contractors and external service providers, for example, for our customer service or the hosting of fitplay. In such cases, information is passed on to these companies or individuals in order to allow them the further processing. These external service providers are carefully selected and regularly reviewed to ensure that your privacy is preserved and that your data is only used for the purposes specified by us. In addition, they are contractually obliged by us to treat your data exclusively in accordance with this data protection statement as well as German data protection laws.
- Within the framework of the development of our business, the structure of our company may change as the legal form is changed, subsidiaries, parts of companies or components are established, bought or sold. In such transactions, the customer information is passed on together with the part of the company which has to be transferred. Whenever personal data is passed on to third parties as described above, we ensure that this is done in accordance with this data protection declaration and the relevant data protection laws.
Your rights as an affected person
You have the right to receive information about the data stored about you at any time. Upon submission of the respective prerequisites, you may also be entitled to correct incorrect data, as well as to block and delete data. Changes to this Privacy Statement
We will update this data protection policy on a regular basis. Therefor we reserve the right to change it from time to time and to postpone changes in the collection, processing or use of your data. The current version of the data protection declaration is always available under the "Contact" section within the app.
